I have to admit that I made the opposite observation. Once ND decided to join the lawsuit against the Obama administration, they made it all the way to a national championship after several dismal seasons. Not that ND is perfect, mind you ... there is still a LONG way to go!
I think of it more like this... ND is like a surgeon who decides to sterilize his bacteria-laden instruments AFTER he's just performed major surgery on vital organs. And they're supposed to be so smart...
